Great Western Bank (“we”, “Great Western Bank” or “Company”) is offering you, (“you,” or the “Advocate,”) the opportunity to refer people (“you” or “Friends”) and get rewards via our Refer A Friend Program (the “Program”) offered on the website located at https://refer.greatwesternbank.com/ (the “Site”). Information about products offered to Friends can be found here: https://www.greatwesternbank.com/checking-referrals/.

1. Binding Agreement. By using the Site or participating in the Program, you acknowledge and agree that you are bound by these Terms and Conditions (“Terms”). These Terms are incorporated into other terms, conditions and agreements you have agreed to through use of Company’s products and services. All of the Company's decisions are final and binding.

2. How the Program Works. Both Advocates and Friends must be legal residents of the United States of America and at least 18 years old to participate in the Program. Next, you must visit the Site and follow the on-screen instructions to refer Friends, for example, your friends, family members or non-Company colleagues, to open a personal checking account at Great Western Bank. Advocates may refer a maximum of 25 friends, family members or colleagues during one calendar year and a maximum of 500 times throughout the entirety of the Program. Once you make a referral, you become an “Advocate.” Friends must open a new Great Western Bank personal checking account within 90 days of receiving a Great Western Bank Refer A Friend invitation and meet the Program requirements by 1) having 20 debit card purchases (online or in person) posted to the Friend’s new Great Western Bank account by the 60th day after account opening and 2) enrolling in online statements OR completing at least one ACH direct deposit transaction (minimum value of $250) into the new account within 60 days of account opening. Transfers from one account to another, or deposits made at a banking location or ATM, do not qualify as direct deposits. Account must be open and in good standing on the 60th day after account opening to be eligible. After Friends open an account and make qualified transactions, you and the Friend will be sent an email that allows you both to receive the benefit or reward advertised on the Site. Friends must complete the referral as described in the referral message. Friends cannot be employed or otherwise affiliated with the Company. Friends cannot be current customers of the Company. Friends cannot have been a primary account holder on a Company personal checking account within the last 12 months of opening a new account. Friends must open their new personal checking account online or in branch within Great Western Bank’s nine state footprint, in Arizona, Colorado, Iowa, Kansas, Minnesota, Missouri, Nebraska, North Dakota and South Dakota.

3. Restrictions. Advocates cannot refer themselves or create multiple, fictitious or fake accounts with the Company or participate in the Program as Friends. No user may use the Program to violate any law, infringe or violate the rights of any third party, or otherwise act in a manner that is deemed harassing, harmful, illegal, hateful, obscene or outside the spirit and intent of the Program. In addition, you may not (i) tamper with the Program, (ii) act in an unfair or disruptive manner, or (iii) use any system, bot or other device or artifice to participate or receive any benefit in the Program. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE COMPANY RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Employees of the Company or any of its or their subsidiaries, affiliates or promotional agencies are not able to participate, neither as Friends or as Advocates.

4. Rewards. If both the Advocate and Friends complete the eligibility and Program qualification requirements, you both will receive a token for a $50 Visa® Prepaid Card.

To redeem the token for access to card funds you will receive an email token requesting you redeem your Card reward. After clicking the link provided in the email, you can chose a digital card, or for a $3.00 fee, you can request a physical card be mailed to you. Please allow up to 7 days, after completion of all requirements of this offer for delivery of your Visa Prepaid Card. These rewards may be redeemed in various forms in the Company's sole discretion. The reward card’s terms and conditions containing additional card use information as well as limitations will be provided to you and your Friend at the time the digital reward token is accessed. You and Friends may need to register the card prior to use online or at certain merchants. Rewards are subject to verification. By redeeming and using the card, both Friends and Advocates acknowledge and agree to the following:

The reward card is not issued by Great Western Bank. You will need to contact the customer service info listed above for any matters directly related to the card. If you have any problems or questions, please contact the card’s customer service by one of the means provided in the table above. Great Western Bank is not responsible if you or Friends need a replacement or the card is not functioning properly. You can be awarded a maximum of $500 per year for referrals. The Company may delay a reward for the purposes of investigation. The Company may also refuse to verify and process any transaction for any reason. Advocates and Friends are only awarded one reward per referred Friend, not per account opened. Offer cannot be combined with other checking bonus offers. Great Western Bank will not be liable if the Visa Prepaid Card is lost or stolen after being delivered to the email or physical address provided at registration by the Advocate or Friend, as applicable. If the Visa Prepaid Card has expired, Great Western Bank is not responsible or required to distribute replacement cards for lost, stolen or expired cards.

5. Privacy Information for the Refer-A-Friend Program. The personal information collected, processed and used as part of the Program will be used in accordance with Company’s Privacy Policy, which is available here: https://www.greatwesternbank.com/privacypolicy/.

6. Privacy Information for the Visa Prepaid Card. Any information you or your Friends provide regarding receiving or using the Visa® Prepaid Card reward will not be subject to Company’s privacy policy, but instead shall be subject to the Visa Prepaid Card issuing bank’s privacy and confidentiality provisions disclosed to you at Reward Card registration and otherwise provided to you. If you wish to obtain a copy of the privacy disclosures for the issuing bank, you may contact the Card Customer Service provided in the table in Section 4 above.

7. Liability. YOU UNDERSTAND AND AGREE THAT THE RELEASED PARTIES (DEFINED BELOW) SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE COMPANY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). By participating in the Program, you agree to defend, indemnify, release and hold harmless the Company and Extole, Inc., as the provider of the referral service, and their respective parent companies, affiliates and subsidiaries, together with their respective employees, directors, officers, licensees, licensors, shareholders, attorneys and agents including, without limitation, their respective advertising and promotion entities and any person or entity associated with the production, operation or administration of the Program (collectively, the “Released Parties”), from any and all claims, actions, demands, damages, losses, liabilities, costs or expenses caused by, arising out of, in connection with, or related to the Program (including, without limitation, any property loss, damage, personal injury or death caused to any person(s)) and/or the awarding, receipt and/or use or misuse of any benefit in the Program. To be clear, the Released Parties shall not be liable for any technical errors or malfunctions, data theft or corruption, any printing or typographical error, or any damage to any computer system resulting from participating in, or accessing or downloading information in connection with the Program. The Released Parties shall not be liable to any users for failure to supply any advertised benefit, by reason of any acts of God, any action or request by any governmental or quasi-governmental entity (whether or not valid), or any other activity or action that is beyond any of the Released Parties’ control. TO THE FULLEST EXTENT POSSIBLE BY LAW, THE RELEASED PARTIES’ MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE PROGRAM, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY, OR OTHERWISE), WILL NOT EXCEED $100. The Company is not responsible for functionality of the Prepaid Card you or the Friend receives as part of this Program. 8. Disclaimer of Warranties. YOU EXPRESSLY UNDERSTAND AND AGREE THAT: (A) THE PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS AND TERMS OF ANY KIND, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW OR CUSTOM, INCLUDING, BUT NOT LIMITED TO, WARRANTIES AS TO PRODUCTS OR SERVICES OFFERED THROUGH THE USE OF THE PROGRAM, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) THE RELEASED PARTIES MAKE AND GIVE NO WARRANTY THAT (i) THE PROGRAM WILL MEET YOUR REQUIREMENTS, (ii) THE PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, AND (iii) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE PROGRAM WILL MEET YOUR EXPECTATIONS, AND (C) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE PROGRAM IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF ANY SUCH MATERIAL.

9. Bulk Distribution (“Spam”). By submitting any email address as part of the Program, the Advocate represents that he/she has the appropriate permission and consent. Bulk email distribution, distribution to strangers, or any other use of the services described herein in a manner that is not promoted is expressly prohibited and may be grounds for your not being able to continue the Program, termination of any rewards, and further legal action. The Company has no obligation to monitor the Program or any communications; however, the Company may choose to do so and block any email messages, remove any such content, or prohibit any use of the Program.

10. Right to Cancel, Modify or Terminate. We reserve the right to cancel, modify or terminate the Program at any time for any reason. We reserve the right to disqualify any participant at any time from participation in the Program if he/she does not agree or comply with any of these Terms.
